We, Appoint BV, a private limited company with registered office at Weg naar Zwartberg 18 bus 2, 3660 Oudsbergen, and registered with the Crossroads Bank for Enterprises under number 0676.765.436 (RPR Antwerp, Tongeren division), would like to inform the visitors of our website through this cookie statement about which cookies and/or similar technologies are used on our website, why we use them, and how you can delete or disable cookies.

This cookie statement may be updated by us if new developments necessitate changes. The most current version of the cookie statement can always be found on our website.

  1. What is a cookie?

A cookie is generally a small text and numerical file that we send and store in your web browser or on your mobile device when you visit our website. When you visit our website again using the same web browser or device, this information is sent back to our website. Cookies help us, for example, to remember your preferences when using our website (e.g., your language choice), unless you have adjusted your browser settings to refuse non-essential cookies.

  1. Types of Cookies

There are different types of cookies. Cookies can be categorized according to their origin:

  • First-party cookies are technical cookies placed by us, which ensure that our website functions properly. This improves the quality of our products and services.
  • Third-party cookies are cookies placed by a domain other than our website. If a user visits a website and a third party places a cookie through that website, it is considered a third-party cookie. For cookies placed by third parties, we refer you to the statements provided by these parties on their respective websites. Please note: we have no control over the content of those statements or the cookies set by these third parties.

Cookies can also be categorized based on their function:

  • Essential or strictly necessary cookies are, as the name implies, necessary for the website to function properly or to provide a service you have requested, e.g., establishing a certain connection. We may place these cookies without your prior consent.
  • Non-essential cookies are cookies that can be placed for statistical, social, targeting, and commercial purposes. They are not related to the purely technical support of the website. Non-essential cookies can be first-party or third-party cookies and can only be placed and used by us if you have given your prior consent through the cookie banner.

Various types of non-essential cookies can be distinguished:

o Functional cookies ensure that certain non-essential functionalities of the website work properly.

o Cookies for statistical purposes allow us to track, among other things, which pages of the website you visit, where your computer is located, etc.

o Cookies for social purposes allow the user to share the content of the visited website directly with others via social media.

o Cookies for targeting purposes allow a profile to be built based on your browsing behavior, so that ads displayed are tailored to your interests.

o Cookies for tracking purposes allow your internet behavior to be tracked over time.

Cookies can also be categorized based on their lifespan:

  • Persistent cookies: These cookies remain on the user’s device for the duration specified in the cookie. They are activated each time the user visits the website that placed the cookie. Most non-essential cookies are persistent cookies.
  • Session cookies: These cookies allow us to simplify and link the actions of a user during a browser session. A browser session starts when a user opens the browser window and ends when they close the browser window. Session cookies are placed temporarily. Once you close the browser, all session cookies are deleted. Most functional cookies are session cookies.

  1. Your rights

To give you more control over the processing of your personal data, you have several rights. These rights are, among other things, established in Articles 15-22 of the GDPR.

You have the following rights:

  • The right to access the personal data we process about you (Art. 15 GDPR):

You have the right to know at any time whether or not we are processing your personal data. If we are processing it, you have the right to access this personal data and receive additional information about:

  1. the purposes of processing;
  2. the categories of personal data concerned;
  3. the recipients or categories of recipients (particularly recipients in third countries);
  4. the retention period or, if not possible, the criteria used to determine that period;
  5. the existence of your privacy rights;
  6. the right to lodge a complaint with the supervisory authority;
  7. the source of the personal data if we obtained it from a third party;
  8. the existence of automated decision-making.

If we are unable to provide you with access to your personal data (for example, due to legal obligations), we will inform you why it is not possible.

You can also request a free copy of the processed personal data in an understandable format. Please note, we may charge a reasonable fee to cover our administrative costs for any additional copies you request.

  • Right to erasure (‘right to be forgotten’) (Art. 17 GDPR):

In certain cases, you can request us to erase your personal data. Please note that your right to be forgotten is not absolute. We have the right to continue retaining your personal data when it is necessary for, among other things, the performance of a contract, compliance with a legal obligation, or the establishment, exercise, or defense of legal claims. We will provide you with further information regarding this in our response to your request

  • The right to rectification and completion (Art. 16 GDPR):

When your personal data is incorrect, outdated, or incomplete, you can request us to correct these inaccuracies or complete the data.

  • The right to data portability (Art. 20 GDPR):

You also have the right, under certain conditions, to request the transfer of the personal data you have provided to us for the performance of the contract or for which you have given consent, to another data controller. Where technically feasible, we will provide your personal data directly to the new data controller.

  • The right to restriction of processing (Art. 18 GDPR):

If one of the following applies, you can request us to restrict the processing of your personal data:
a) you dispute the accuracy of the personal data (in this case, its use will be restricted for a period that allows us to verify the accuracy of the data);
b) the processing of your personal data is unlawful;
c) we no longer need your personal data for the original processing purposes, but you need it for the establishment, exercise, or defense of legal claims;
d) as long as no decision has been made regarding the exercise of your right to object to the processing, you can request to restrict the use of your personal data.

  • The right to object (Art. 21 GDPR):

You can object to the processing of your personal data based on your particular situation if the processing is based on our legitimate interest or the performance of a task carried out in the public interest. In that case, we will stop processing your personal data unless we can demonstrate compelling and legitimate grounds for processing that override your interests, or when the processing of personal data is related to the establishment, exercise, or defense of legal claims.

  • The right not to be subject to automated decision-making (Article 22 GDPR):

You have the right not to be subjected to a decision that is based solely on automated data processing, which significantly affects you or has legal consequences, and which is made without substantial human intervention.

There are three situations in which you cannot invoke this right:

  1. a) if the law permits it (e.g., to prevent tax fraud);
    b) if the decision-making is based on the explicit consent of the data subject; or
    c) if it is necessary for the conclusion or performance of a contract (note that in this case, we always assess on a case-by-case basis whether there are less privacy-invasive methods to conclude or execute the contract).
  • The right to withdraw your consent (Art. 7 GDPR):

When your personal data is processed based on your consent, you can withdraw this consent at any time upon simple request.

Exercising your rights

To exercise these rights, you can contact us using the contact details provided under the heading “Questions?”. To verify your identity, we ask you to send a copy of the front side of your ID card. We request that you make your national registration number and photo unreadable on your ID card. In any case, we will process your ID card details solely to verify your identity and will not store or register them in our systems.

You can exercise all these rights free of charge, unless your request is clearly unfounded or excessive (e.g., due to its repetitive nature). In such cases, we have the right to charge a reasonable fee or refuse to comply with your request.
